1. Acceptance of Terms
Welcome to SwiftPay. By accessing or using our website, mobile application, or any of our services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms in their entirety, you may not access or use the Service.
These Terms constitute a legally binding agreement between you and SwiftPay Inc. ("SwiftPay," "we," "us," or "our"). We reserve the right to modify these Terms at any time. Your continued use of the Service after any such changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
2. Description of Service
SwiftPay provides an online card-to-card money transfer service that enables users to send funds directly from one debit or credit card to another. Our Service facilitates instant transfers between cards issued by participating financial institutions, without requiring traditional bank account linking or lengthy verification processes.
The Service includes:
- Real-time card-to-card transfer processing
- Support for Visa, Mastercard, and other participating card networks
- Transparent fee display before transaction confirmation
- Transaction history and receipts
- Customer support for transfer-related inquiries
We do not hold, store, or intermediate funds beyond the time required to complete a transfer. The Service is intended for personal, non-commercial use unless otherwise expressly permitted.
3. Eligibility
To use the SwiftPay Service, you must meet the following requirements:
- Age: You must be at least 18 years of age or the age of majority in your jurisdiction of residence, whichever is greater.
- Legal Capacity: You must have the legal capacity to enter into binding contracts and to comply with these Terms.
- Residency: You must be legally permitted to use financial services in your country of residence.
- Compliance: You must not be prohibited from using the Service under applicable law, including sanctions or embargo regulations.
By using the Service, you represent and warrant that you meet all eligibility requirements. We reserve the right to verify your eligibility at any time and to refuse or suspend service to any user who does not meet these requirements or who we reasonably believe has violated these Terms.
4. Account and Card Information
You are responsible for providing accurate, current, and complete information when initiating a transfer. This includes, but is not limited to, the card numbers of the source card (the card from which funds are sent) and the destination card (the card to which funds are received), as well as any other details required to complete the transaction.
By using the Service, you represent and warrant that:
- You are the authorized cardholder or have explicit authorization from the cardholder to use the card for transfers
- All information you provide is true, accurate, and complete
- You will not use cards obtained unlawfully or without the cardholder's consent
- You have sufficient funds or available credit on the source card to complete the transfer, including any applicable fees
SwiftPay is not responsible for transfers sent to incorrect card numbers due to user error. It is your responsibility to verify the destination card details before confirming a transfer. Transfers to incorrect recipients may not be reversible.
5. Fees and Charges
SwiftPay charges a service fee of 1.5% of the transfer amount for each card-to-card transaction. This fee is clearly displayed to you before you confirm a transfer. There are no hidden fees; the amount shown at checkout is the amount you will be charged.
Our fee structure is designed to be transparent:
- Service Fee: 1.5% of the transfer amount, calculated and displayed before confirmation
- Total Charge: The transfer amount plus the service fee is the total amount debited from your source card
- Recipient Amount: The full transfer amount (before fees) is credited to the destination card, minus any fees that may be applied by the recipient's card issuer or bank
Please note that your card issuer or bank may impose additional fees (such as cash advance fees, foreign transaction fees, or currency conversion fees) that are separate from SwiftPay's charges. We recommend consulting your financial institution for details about their fee structure.
Fee rates are subject to change. Any changes will be communicated in advance and will apply to transfers initiated after the effective date of the change. Your acceptance of the fee amount at the time of transfer constitutes agreement to the fee charged for that transaction.
6. Transfer Limits
SwiftPay imposes the following transfer limits to protect users and ensure compliance with regulatory requirements:
- Minimum Transfer: $10 (USD or equivalent in supported currencies)
- Maximum Transfer: $50,000 (USD or equivalent) per single transaction
- Daily and Monthly Limits: Additional limits may apply based on verification status, jurisdiction, or risk-based assessments. These limits will be communicated to you during the transfer process or via your account dashboard.
We reserve the right to adjust limits for individual users or regions based on regulatory requirements, fraud prevention, or operational considerations. You will be notified of any limit that applies to your account. Attempting to circumvent transfer limits is a violation of these Terms and may result in suspension or termination of your access to the Service.
7. Prohibited Activities
You agree not to use the SwiftPay Service for any unlawful, fraudulent, or abusive purpose. The following activities are strictly prohibited:
- Money laundering, terrorism financing, or any activity that violates anti-money laundering (AML) or counter-terrorism financing (CTF) laws
- Fraud, including the use of stolen cards, unauthorized card information, or identity theft
- Transfers related to illegal goods or services, including but not limited to drugs, weapons, human trafficking, or illegal gambling
- Circumventing or attempting to circumvent transfer limits, verification requirements, or security measures
- Using the Service to evade taxes or regulatory requirements
- Harassment, extortion, or coercion of other users
- Reverse engineering, decompiling, or attempting to extract the source code of the Service
- Interfering with or disrupting the Service, including through denial-of-service attacks or introduction of malware
- Reselling or commercially exploiting the Service without our prior written consent
We cooperate fully with law enforcement and regulatory agencies. Violation of these prohibitions may result in immediate suspension or termination of your access, reporting to authorities, and legal action. We reserve the right to refuse or reverse any transaction we suspect violates these Terms or applicable law.
8. Privacy and Data Protection
Your privacy is important to us. Our collection, use, and disclosure of your personal information are governed by our Privacy Policy, which is incorporated into these Terms by reference.
By using the Service, you consent to the practices described in our Privacy Policy, including:
- Collection of card information, transaction data, and identification details necessary to process transfers
- Use of your information to prevent fraud, comply with legal obligations, and improve our services
- Sharing of information with our payment processors, card networks, and regulatory authorities as required

9. Intellectual Property
All content, features, and functionality of the SwiftPay Service, including but not limited to text, graphics, logos, icons, images, software, and design elements, are the exclusive property of SwiftPay Inc. or our licensors and are protected by copyright, trademark, and other intellectual property laws.
You may not:
- Copy, modify, distribute, or create derivative works based on the Service or its content
- Use our trademarks, logos, or branding without our prior written consent
- Remove or alter any copyright, trademark, or other proprietary notices
- Use the Service to build a competing product or service
We grant you a limited, non-exclusive, non-transferable license to access and use the Service for its intended purpose in accordance with these Terms. This license does not convey any ownership rights.
10. Limitation of Liability
To the maximum extent permitted by applicable law, SwiftPay, its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, arising out of or related to your use of or inability to use the Service.
Our total liability for any claims arising from or related to the Service shall not exceed the greater of (a) the amount of fees you paid to SwiftPay in the twelve (12) months preceding the claim, or (b) one hundred United States dollars ($100 USD).
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law. Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded or limited by applicable law.
11. Dispute Resolution
If you have a dispute with SwiftPay arising from your use of the Service, we encourage you to contact our support team first at support@swiftpay.com. Many issues can be resolved quickly through direct communication.
If we cannot resolve the dispute informally, you agree that:
- Informal Resolution: You will attempt to resolve the dispute through good-faith negotiation for a period of at least thirty (30) days before initiating any formal proceedings.
- Binding Arbitration: Any unresolved dispute shall be resolved by binding arbitration in accordance with the rules of the American Arbitration Association (AAA) or a comparable arbitration body in your jurisdiction. The arbitration shall be conducted in English, and the arbitrator's decision shall be final and binding.
- Class Action Waiver: You agree to resolve disputes with SwiftPay on an individual basis only. You waive any right to participate in a class action, class-wide arbitration, or any other representative proceeding.
This dispute resolution section does not prevent you from reporting violations to regulatory or law enforcement authorities.
12. Modifications to Terms
We may modify these Terms at any time. When we make material changes, we will notify you by:
- Posting the updated Terms on our website
- Updating the "Last updated" date at the top of this page
- Sending an email notification to registered users, where applicable
- Displaying a notice within the Service
Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the modified Terms, you must discontinue use of the Service. We recommend that you review these Terms periodically to stay informed of any updates.
13. Governing Law
These Terms and any dispute or claim arising out of or in connection with them or the Service shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles.
Any legal action or proceeding arising under these Terms shall be brought exclusively in the federal or state courts located in Wilmington, Delaware, and you consent to the personal jurisdiction of such courts. This governing law clause does not affect any mandatory consumer protection rights you may have under the laws of your country of residence.
